A recent Florida Second District Court of Appeal decision confirms that individual condominium unit owners can challenge a mechanic's lien, even when the contract was between the contractor and the association. In a new article, Adams & Reese construction Partner Ryan Owen (Sarasota) and Associate Allison Zunica (Tampa) explain the court's ruling affirming a unit owner's right to challenge a mechanic's lien arising from work contracted by the condominium association. The decision makes clear that unit owners who did not consent to the underlying work are not left without recourse simply because the association approved it. For developers, association boards, and unit owners dealing with construction-related disputes in Florida, the ruling has important practical implications.
