Learning Resources and hand2mind Return to Court to Challenge Section 301 Tariffs Learning Resources, Inc. and hand2mind, Inc. have today filed a legal challenge in the U.S. Court of International Trade against the U.S. Trade Representative’s newly announced Section 301 tariffs. The USTR’s action imposes tariffs in the amount of 10% or 12.5% on 60 economies, representing 99.4% of all U.S. imports. As confirmed by the landmark case Learning Resources, Inc. v Trump, tariffs are taxes and it will be American importers who pay them. For the third time in less than 18 months, the Administration is taking steps to impose essentially the same sweeping global tariffs first levied under the International Emergency Economic Powers Act (IEEPA). The Supreme Court invalidated those tariffs in the Learning Resources case on February 20, 2026. That same day, the Administration imposed materially identical tariffs under Section 122 of the Trade Act, an action the Court of International Trade declared unlawful in May. Shopping for a third tariff law to impose the same tariff scheme fares no better. This is simply another brazen attempt by the Administration to levy billions of dollars in taxes on Americans in contravention of Congressional limits. Our Constitution is clear on this point: the power of taxation belongs to Congress, not the Executive Branch. As family-owned, mission-driven companies, we are taking this action to protect our 500+ employees, our customers, and the schools and families who rely on our products every day. We remain committed to our mission, We Bring Learning to Life, and will continue to support the educators, families, and children around the world who depend on us. We are proud to stand up on behalf of Rule of Law as we seek clarity from the courts on this important issue.
