SALT LAKE CITY (AP) — Both people accused in the kidnapping of Utah teenager Elizabeth Smart have now been declared mentally incompetent to stand trial.
A decision Tuesday by 3rd District Judge Judith Atherton will send Brian David Mitchell to a state hospital until he is deemed fit to stand trial. Last year the judge ruled Mitchell's wife, Wanda Barzee, wasn't competent to stand trial either.
