Jordan Jensen liked thisJordan Jensen liked thisCan a bar escape dram shop liability simply because the driver was below .08? Not necessarily. Indiana's Court of Appeals held in Flynn v. Kenneth Mobley, Inc. that a jury should decide whether a tavern had actual knowledge of a patron's visible intoxication. The driver consumed five drinks in about two hours, then drove the wrong way down a one-way street and caused a head-on collision. Despite a BAC of only .061-.066, evidence of slurred speech, dilated pupils, and alcohol odor created a factual dispute that made it error for the trial court to enter summary judgment for the defendant. The decision is below. We loved getting together once a quarter to swap notes, talk about our industry, interests and bounce ideas off one another. One day over lunch, he mentioned a client's daughter had been in a car accident. He practiced criminal defense. He did not handle PI cases and had never sent one out before. He did not know where to send it. He sent it to me because he knew me. Not because of my website. Not because of an ad. Because we had sat across from each other enough times that he trusted me with someone who mattered to him. That case turned out to be one of the most important we handled that year. I think about that every time I build a relationship with fellow lawyers in different industries. What I have learned is the relationships that produce referrals are not built on transactions. They are built on time. On showing up. On being the person someone thinks of when the question is "who do I trust with this?" If you practice criminal law, family law, immigration, or estate planning and you have clients who get hurt, you are going to face that question. I want to be the answer. Interested in connecting? The November 2025 CPI confirms that recent inflation readings are mechanically BIASED LOWER, not purely driven by real price dynamics. Because of the federal government shutdown, the BLS did not collect any CPI survey data for October 2025 and was unable to recover it later. As a result, large parts of the CPI calculation relied on imputation and carry-forward methods, where September prices were reused as placeholders (!). In categories with already-slowing inflation, this effectively assumed near-zero monthly price changes, pulling reported inflation down. The CPI rose 0.2% over the two months from September to November, with headline inflation at 2.7% YoY and core inflation at 2.6% YoY. Shelter inflation appeared especially soft, reinforcing the perception of rapid disinflation. However, this softness partly reflects missing data and statistical assumptions, not necessarily faster real-world price declines. Government shutdown and “carry-forward” prices - BLS explicitly notes that CPI data collection for October was interrupted and only resumed on November 14, forcing them to carry forward prior prices in several series. - Economists point out that for shelter, this meant effectively flatlining prices from September into October/November in parts of the sample, even though private rent measures did not show zero inflation! The lack of October survey data means the downward bias can persist into future CPI prints, particularly through shelter and core components. As a result, CPI readings may look softer than underlying inflation pressures actually are, increasing the risk of misinterpreting the true inflation trajectory when assessing growth, policy, and rate expectations. #inflation #commodities #rent #cpi #thefed #bonds #yields #rates #macro #stocks

My recent post (https://lnkd.in/ef4Y45qD) discussing Fidelity's decision to block 401K plan participants from allowing their professionals to help guide and advise on the retirement accounts got me thinking about the volume of passive investing in 401(K) accounts. According to Apollo Global Management, Inc.: + US workers contribute on average around $8.5K to their 401(k) accounts every year. + 71% of 401(k) assets allocated to equities + the Magnificent Seven account for ~40% in the S&P 500 = the average worker in the US invests ~$2.3K into the Magnificent Seven stocks every year, regardless of their outlook or price. Dollar Cost Averaging is the most successful way to compound your money long-term; however, knowing what you're buying and at what price is an equally important input that the majority of investors ignore.
