Six South Texas physicians and their practices have agreed to pay $4.86 million to resolve allegations that they submitted false claims to Medicare, Medicaid, and TRICARE for services that were not rendered or were not medically necessary. The settlement involves Benchmark Inpatient Services (BIS), Benchmark Pulmonary Center (BPC), and their physician owners. From January 2020 through May 2023, the government alleged the providers: 1. Billed critical care services for patients who were stable, for unnecessary follow-up visits, or for services not performed. (Critical care billing requires at least 30 minutes of treatment and complex decision-making for critically ill or injured patients.) 2. Billed pulmonary function tests (PFTs) as routine or unnecessary testing, or for services not provided. Medicare only reimburses PFTs when medically necessary and properly documented. As a result, federal healthcare programs allegedly paid for services that did not meet coverage and documentation requirements. The case originated from a whistleblower (qui tam) lawsuit under the False Claims Act and was investigated by HHS-OIG, the FBI, and other federal and state partners. The settlement resolves allegations only, and there has been no determination of liability. Cases like this highlight the importance of accurate documentation, medical necessity validation, and internal auditing of high-risk services such as critical care and diagnostic testing. BUCA contracts for 883 Texas independent family medicine groups. No health systems or large multispecialty platforms. Commercial fee for service only, normalized to the same Medicare locality and compared across their most commonly billed codes. One of the things I find most interesting about the U.S. healthcare market is how differently each payer behaves when establishing contracts with providers. There is a lot of shorthand in the industry. You often hear that “Blues” pay well, UHC pays poorly, and Cigna or Aetna are hit or miss. When you line the contracts up side by side, the picture feels more nuanced. These are the same 883 practices, each holding contracts with the major BUCA payers. Yet within that identical cohort, reimbursement with UHC ranges from roughly 60 to 160 percent of Medicare. BCBS Texas clusters more tightly, closer to 70 to 105 percent. Aetna and Cigna fall somewhere in between, each with their own distribution patterns. What stood out was not simply variation across practices, but how differently the dispersion behaves depending on the payer, even though the underlying provider group is the same. If the providers are identical across the analysis, what explains why one payer shows a 100 point spread while another clusters more tightly? Is it contracting philosophy, market share, legacy agreements, or local negotiation dynamics? Data sourced by PriceMedic from February Transparency in Coverage publications by Cigna, UHC, Aetna, and Blue Cross Blue Shield of Texas. Contracts analyzed based on the top 10 E and M codes billed by family medicine.

Texas Attorney General Sues Epic??? Texas Attorney General Ken Paxton filed a lawsuit Dec. 10 against EHR vendor Epic, accusing the company of monopolizing the EHR market and engaging in deceptive practices that restrict parents’ access to their minor children’s medical records. The lawsuit claims Epic uses exclusionary tactics to maintain dominance in an industry where its software manages more than 325 million patient records, covering about 90% of U.S. residents. According to the complaint, Epic interferes with hospitals’ ability to use their own patient data and employs practices that prevent partners, customers and employees from developing competing products. Mr. Paxton alleges those actions hinder competition, raise costs for Texas hospitals and patients, and may result in physicians receiving incomplete or outdated records. The lawsuit also challenges how Epic handles minors’ health information. According to the complaint, the company automatically restricts parental access to medication lists, treatment notes and provider messages once a child turns 12. Mr. Paxton argues that this practice violates Texas Health and Safety Code §183.006, which grants parents full access to their children’s medical records. #epic #texasag #accessmedicalrecords

The wildest part isn’t the fraud… it’s how easy it was to pull off! A practicing physician in Houston, TX ——> Dr. Ajay Aggarwal, an anesthesiologist has agreed to pay over $2 million to resolve allegations that he billed Medicare and other government payers for invasive spinal surgeries that, the DOJ says, never happened. Instead, patients received something far simpler, electro‑acupuncture devices taped behind the ear, barely penetrating the skin. No surgeries… just plain ole sticky patches. What’s often unseen and this is where I pause, and maybe you pause too… is what fails before it becomes fraud. Credentialing, rigorous checks, compliance processes all seem like red tape to providers and other team members, until they aren’t. It’s not just about catching bad actors, it’s about preventing the opening for bad behavior in the first place. So, how can we… gently shift the conversation? • How do we make credentialing actually proactive rather than reactive? • What’s are our roles, as clinicians, administrators, or tech innovators, to design systems that don’t just flag fraud, but guard against the drift toward it? Just maybe, we stop reading heartbreaking headlines and instead build ecosystems where trust isn’t assumed, but constantly reinforced. APRN Practice: Physician Delegation When Texas APRNs provide medical aspects of care with patients located in Texas, they are required to do so under the delegated authority of a Texas licensed physician [Board Rule 221.13.(https://lnkd.in/gRcNHCjV)] Examples of medical aspects of care include but are not limited to: the creation of a medical plan of care, ordering labs or other diagnostic tests, utilizing any assessment information to formulate a medical diagnosis or the absence thereof, and ordering or prescribing drugs and devices. Additionally, determinations that a patient is medically stable, fit for duty (such as is required for a DOT exam), or is eligible to receive or continue certain services are medical determinations. These aspects of care are beyond the RN scope of practice, and an APRN must have a physician delegation agreement in place to make such determinations.
