Work family is more appropriate. Years ago, we started off building Google’s legal discovery team. Many of us are in different places now, but getting the group back together reminded me that the best part of a career isn’t the wins, the cool office buildings, or the perks - but it’s the people you share the journey with. Grateful for over a decade of friendship that has outlasted countless re-orgs, building moves, offsites, happy hours and shuttle bus rides.

Ming Zhu reacted on thisMing Zhu reacted on thisGetting inducted into the American College of Trial Lawyers this weekend was surreal. It was hard not to look at all of these legendary trial lawyers around me and not wonder how on earth I got here. I thought about how lucky I was to have clerked for a judge who became the first person to tell me I should be a trial attorney, a thought that had never occured to me before. I thought about my first client who went to trial at the Federal Public Defender, Central District of California, and how he was facing a 20-year mandatory-minimum sentence when he slid me a Post-It note after closing arguments (before the acquittal) that said, “No matter what happens you did a great job.” I thought about all of the incredible friends and mentors I met at the FPD who fought with me in the trenches in the most grueling and rewarding job a trial lawyer could have. I thought about all of my AUSA counterparts who served as worthy trial adversaries, and in some cases, great teachers. I thought about my partners at Bird Marella who first gave me a chance to try cases in private practice and convinced big clients to staff me on prominent trials. I thought about my firm Manatt, Phelps & Phillips, LLP and how they put faith in me to lead the firm’s Trial, White Collar and Investigations Unit to help shape our next generation of trial attorneys. I thought about my first-rate trial partners, whom I work with and learn from everyday. I thought about all of the women and Asian American attorneys who have offered me unwavering emotional support in this big competitive, cutthroat career. I thought about my husband Jeremy Gruhlkey, who bears the brunt of all my stress but never fails to show up for me, and without whom all of this would fall apart. But most of all, I thought of my dad, who dreamed of becoming a lawyer in Korea but came to America instead to work everyday of his life, doing everything from making donuts to selling cell phones, so that in one generation, I could realize that dream instead. I thought about how I wished he was still here so that I could tell him about this weekend. I am so thankful to the ACTL for this honor. They kept telling us all weekend how rigorous the selection process is, and how many people had to say yes for us to get here, but all I heard was that no one gets anywhere alone. I am blessed to know all of the people who helped me along the way, who are too many to name or count. Thank you, and looking forward to continuing this journey together. https://lnkd.in/gB39iuFZ

You can read more about Carnegie and what it’s accomplished here: https://lnkd.in/gX5z6n34 When I return to Stanford this summer, I’ll be leading the Center for Advanced Study in the Behavioral Sciences (CASBS at Stanford) and I’ll succeed John Hennessy in leading the Knight-Hennessy Scholars Program. I’ll also rejoin Stanford Law School and be affiliated with the Stanford Institute for Human-Centered Artificial Intelligence (HAI). I expect to continue working on democracy, artificial intelligence, and international security, but I’ll also collaborate with colleagues on education and keeping our research infrastructure vibrant and innovative in a fragmented world. Thank you to so many extraordinary friends and colleagues at Carnegie and Stanford.

She only had a LinkedIn account to keep up with my activity on here! And I am so grateful that I was able to be there to hold her hand as she left this world. My world has not been much larger than a hospital room in Oklahoma City over the past few weeks, but as my lens begins to widen again, I am horrified by what we are seeing in our Twin Cities communities. I am grateful for the leadership of Jessica Klander at the Hennepin County Bar Association and Maya Missaghi at the Ramsey County Bar Association. As I've stated before, and will be detailing in an upcoming post, the CA Delete Act's enforcement provisions will make it the most significant privacy law in America when the law's statutory penalties for non-compliance with the Delete Request and Opt-out Platform (DROP) come into effect on August 1, 2026. Any unregistered data brokers should be paying close attention to this issue.

Anthropic released a legal plugin for Claude last week. It automates contract review, NDA triage, and compliance workflows - all open-source and customizable to your organization's playbook. I've been testing it out. Here's what stood out: This is foundation work, not a finished product: This handles contract review, but legal teams need approval workflows, version control, e-signatures, and matter management integration. Building that yourself means significant technical resources, ongoing maintenance, and integration work. Yes, it can integrate via MCP, but the difference between this and mature legal operations platforms is established trust, compliance certifications, proven security frameworks, and years of domain expertise baked into workflow design. Legal ops leaders may find that the hidden costs add up quickly. This should worry vendors whose product is Claude wrapped in a nice UI, but end-to-end legal operations platforms with security frameworks, compliance track records, and deep workflow expertise are probably fine. The real opportunity here is what gets built on top of this foundation. I'm genuinely excited to see what in-house legal teams create with this - and how vendors use it as a starting point to build more comprehensive solutions. Open-source foundations like this could accelerate a lot of interesting work in legal tech. #LegalTech #LegalOps #Claude #AI

After recently moving to California, I’ve been paying increased attention to how the state approaches consumer data protection. One initiative that stands out is the Delete Act and its implementation through California DROP (Delete Request and Opt-Out Platform). DROP gave California residents a practical way to exercise their privacy rights by submitting a single request to delete personal data or opt out of its sale across hundreds of registered data brokers. Beginning August 1, 2026, data brokers will be required to process these requests and delete the data within 90 days, and respond to subsequent requests within 45 days. This is what privacy regulation looks like when it’s designed to actually work for people. Too often, data privacy laws sound good on paper but are difficult to use in practice. DROP changes that by making control over personal data centralized, accessible, and enforceable. As someone new to the state, it’s encouraging to see California continue to lead with solutions that prioritize consumers and not just compliance. Big shift coming for privacy programs in California! Last month, the California Privacy Protection Agency (CPPA) approved major amendments to the CCPA Regulations, marking a move from “say-you-do” compliance to “show-you-do” accountability. Starting January 1, 2026, and phasing through 2030, businesses will need to prove that they’re protecting personal information responsibly. Four major rule areas were added: 1. Need for cybersecurity audits: annual, independent reviews of a business’s security program, complete with executive certification (under penalty of perjury). 2. Risk assessments are required before or during any high-risk processing (selling/sharing data, using sensitive data, or deploying AI/automated tools). 3. Automated Decision-Making Technology (ADMT): pay attention to the new notice, opt-out, and access rights for individuals when algorithms make “significant” decisions about them. 4. Also, watch out if your're operating in the insurance sector, as there are insurance specific obligations. This affects businesses meeting CCPA thresholds (>$25M revenue, ≥100k consumers/households, or 50% of revenue from data sales/sharing), but, importantly, even service providers not directly regulated will feel the ripple effect, as their clients will soon demand audit cooperation, risk assessment inputs, and AI transparency clauses. Important deadlines to watch: 2026: Compliance begins 2027: ADMT obligations take effect 2028–2030: Staggered executive certification deadlines based on annual revenue This all sounds scary, but, if you already conduct GDPR DPIAs, SOC 2, or ISO audits, you’re ahead. Build on what you have rather than starting from scratch.

The MSA extension- An amendment comes in from a customer to extend the term of the MSA. This MSA is a relic. Signed much before you were born. From the dark ages. Heavily one-sided. You immediately see this as an opportunity to add some basic protections — clarity on IP ownership, a proper LoL cap, warranties around AI outcomes, and alignment with how the product actually works today. But you’re also slightly nervous about how the Account Owner is going to take this. They think this is a day’s job. Little do they know… you’re about to go gung-ho. Now the real question: Do you take this up? Or do you let it go? If this is an important account, what criteria would you use to decide whether to leave the MSA as-is? When an MSA says the vendor owns all IP - 𝘳𝘦𝘨𝘪𝘴𝘵𝘦𝘳𝘦𝘥 𝘢𝘯𝘥 𝘶𝘯𝘳𝘦𝘨𝘪𝘴𝘵𝘦𝘳𝘦𝘥 - it can sound a bit intimidating. In SaaS heavy relationships, so much of the product sits in the grey space of unregistered IP: underlying code, opensource tools, interfaces, documentation, basically everything that isn't formally patented or trademarked. The clause ends up looking disproportionately broad, and a lot of customers instinctively pushback because it feels like they are signing away something. But most of the time, this language is simply vendor protecting the full stack of what they've built, not an attempt to claim rights over your data or processes. The real question as a customer is not '𝘸𝘩𝘺 𝘥𝘰 𝘵𝘩𝘦𝘺 𝘸𝘢𝘯𝘵 𝘵𝘩𝘪𝘴' but '𝘸𝘩𝘢𝘵 𝘥𝘰𝘦𝘴 𝘵𝘩𝘪𝘴 𝘮𝘦𝘢𝘯 𝘧𝘰𝘳 𝘮𝘦'. The answer is very practical You can absolutely accept broad IP language if your usage rights, data rights and exit rights are drafted clearly. The clause becomes problematic only when the breadth of 'unregistered IP' is used to blur who owns what - your data, your customizations or anything derived from your data. That's where negotiation becomes important. But in a well balanced contract, vendor ownership over both registered and unregistered IP is a harmless boilerplate. #InHouseLegal #ContractNegotiation #IPRights #SaaSContracts #LegalInsights
